MTV: Chris Brown Sentenced To Five Years Probation

August 25th, 2009

Judge also kept in place a protective order to keep Brown away from ex-girlfriend Rihanna.

Chris Brown was formally sentenced in a Los Angeles courtroom Tuesday (August 25) stemming from his February altercation with then-girlfriend Rihanna.

The terms of the plea deal the singer agreed to last month in the case are largely the same, including 180 days of community labor work, a year of domestic-abuse counseling and five years’ probation. The judge, however, did not lift the protective order issued against Brown, warning him that he must stay away from Rihanna for five years, until August 25, 2014, when his probation period is over.

Judge Patricia Schnegg then told Brown she is not one to believe hearsay, but she informed the singer she was “not immune from the chatter that has been on the airwaves” about meetings between the couple. When asked if he understood the protective order and the conditions — which require the singer to stay at least 100 yards from Rihanna or 10 yards away from her during music-industry events they both attend — Brown quietly told the judge “yes.”

Brown arrived to the proceedings 10 minutes early and sat next to his attorney, Mark Geragos, without saying much. He wore a dark, pinstripe suit and appeared stern throughout. At one point, he answered the judge prematurely, earning a playful rebuke from Schnegg and he flashed a brief smile.

The proceedings were swift as Schnegg confirmed the previously agreed to conditions, including that Brown complete his labor service and counseling in his home state of Virginia. Schnegg also said that Brown would be supervised directly by the Richmond police chief.

Brown was due to be sentenced earlier this month, but Schnegg said the court needed more time to verify Virginia’s labor-service intensity. Judge Schnegg told Brown she wanted him to do manual labor for his commitment — including graffiti removal, trash pickup and washing vehicles — rather than community service.

The singer will be required to report to a probation officer in Los Angeles and return to California every three months to see Schnegg. Brown is scheduled to appear back in court November 19 to update the judge on his status, which will include proof of his enrollment in a domestic-abuse program by the Commonwealth Catholic Charities. Brown is due to report to probation in 72 hours following Tuesday’s hearing.

In addition to the terms of his plea deal and the protective order, Brown must also pay a number of fees and fines, while also being subject to random searches and seizures.

Rihanna’s attorney, Donald Etra, was also present at the hearing. Rihanna did not press charges against Brown, but her lawyer had attended other court dates since the incident. Etra declined to speak on the nature of his client’s relationship with Brown and would not comment regarding the sentence.

He did say Rihanna was told at the last hearing, which she attended, the conditions of Brown’s plea deal and did not object to the punishment. At the last hearing, Etra stated that Rihanna did not wish to impose the protective order, but the judge said she would keep it. Rihanna may move to modify the terms, Etra explained, but it’s under the court to decide to change it or not.

“There were no surprises in court this afternoon. The court imposed the sentence,” Etra told reporters outside the courthouse. “Rihanna was advised of the plea agreement before it was entered by Mr. Brown. She did not object at that time. The stay-away order was imposed by the court.”

omg he is so sexy and i cant believe all of this happened to him :-(

  • http://intensedebate.com/people/iSOUL iSOUL

I forgot that was today. I thought it was on Friday for some reason.
Anywho! How beautiful does he look in that suit?!

I'm a sucker for a smartly dressed man. I love it!

I'm glad that there protective order is still in place. Others may beg to differ, but everything happens for a reason. I also think, although the protective order is more for Rihanna's "safety", it actually protects Chris from having to be in a potential dangerous situation again.

That's my two cents, I'm off to gawk at the pics of him in his attire =) .

  • Sam

I'm so glad this day finally came.

I think the protective order is wayyyy too harsh!! What do you guys think? I mean for him to have ZERO contact with her, even through a 3rd party and to stay 100 yards away (why'd she upgrade it from 50??) while not at industry events is a little unrealistic! I am sure even if he does everything he can to stay away from her that they'll still cross paths without him intending to do so.

Her attorney said she'd have to physically appear in court if she wanted that lifted. I hope she does that, just for Breezy's sake. It'd be a shame if his probabtion gets violated because he ACCIDENTALLY ran into her.

I wonder when he'll do his first interview…..

Anyway, I cannot WAIT until he releases a new single and Graffitti comes out!!

  • melissa

its crazy ,,,,, the should reconsider… the hole case…

  • http://intensedebate.com/people/cblover2umay5 cblover2umay5

CHRIS,or should i say "my bestee" does look good in that suit<3!!!!!:) the case is a little
harsh, but hey, he gotta do what he gotta do. i am glad that he's coming back home to
his home town, which is not far away from where i am. i hope the best goes to my bestee!!!

  • ladiiVa

i'm just glad its over with.
& he can go on with his life.
I AM glad that the judge kept the stay away order.
    everything happens for a reason
i believe its the best for the both of them.
i'll keep chris and his family in my prayers.
i definately can't wait til his new album comes out

  • diva

dating rihanna was a mistake from the beginnig he is too way better than her mmi fel sorry for him he s a good guy he doesnt dserve that harsh sentence five years is too longggggggggggggggggggggggggggggggggggg

  • diva

i feel sorry for him ,,thats what i meant

  • Redcupcake

Damn I really feel bad for him. If that was me I don’t even know if I could take it. I mean he got all this hate and his whole life messed up over one person. I’m not saying it was all her fault but I know she played a BIG part. He probably has low self esteem or had it while he went through this. How is the judge gonna go by hearsay when 90% of a story in the media isnt true. Or alot isn’t true. I think she let the media get into her train of thinking. I hate it when ppl say he got off easy because I bet if they were in the same situation they wouldn’t want to go to jail. NOBODY wants to go to jail!! 5yrs is a long time. But on the other side he has been good and hasn’t broken the law until now. So he shouldn’t get into anymore trouble. I’m just concerned about the stay away order because they could be in the same state and she could try to talk to him but I think he’s smarter and wiser now. It seems like he has grown up alot and I don’t think she has because it seems like she’s playing games with him like the hotel thing and the restraunt and everything else. I think that she thinks if she does weird and strange things or dresses “cute” (I think it’s creepy and strange but whatever) then he will want her back. He dosent do out-of-the-box things so he gets attention to me he seems like a regular guy who just hangs out with his friends and family and dosent seek attention. But anyway I wouldn’t be able to handle what he’s going through I mean we only get a tiny itty bitty teeny piece of what he must be going through I’ve Been reading about this on other blogs and they agree that the sentence is harsh but I know he will do what he has to do. Hopefully but everything and I mean EVERYTHING happens for a reason so this will only have a good outcome on his part. Oh yea he look good in that suit!!!!! Damn

  • CB's Wifey :)

Thank God its now all over, and in the past. Everyone can just move past all this. I think 5 years probation is too harsh, but atleast hes not going to jail :) On the bright side, he looks sooo good in that suit. Cant wait for Graffiti to come out :D

  • http://intensedebate.com/people/oceanmate oceanmate

Chris look stunning in his navy blue pinned stripped suit. I am truly glad that the wait is finally over for Chris and his Mom, Mrs. Joyce. I personally feel troubled at this time by the amount of yards being increased to 100 yards in regards to the stay away order (I could understand it better if I his sentence was not already so harsh). On a positive note, Chris all of your fans are still waiting for your music. Ride or die we are still commited

  • CandyLand

So the stay away order is STAYING. Good. Na na na na hey hey hey GOODBYE! Peace out rihanna all you have done is destroy lives. GOOD RIDDANCE!

  • http://intensedebate.com/people/Tima1 Tima1

    @iSOUL
This formal hearing as originally scheduled for Aug 27th but suddently moved to today.

Chris as dressed to impress, lol. In my opinion, this is the look that suits him well. B)

I find it interesting that so many ppl rejoice at this stay away order knowing good and well they would NOT want to be told my a judge of all ppl who they can and cant talk to. Its not about them getting back together but they both run in the same circles and work in the same industry if he is 5ft vs 10 ft from her he can go to PRISON simple as that. Who has time to rememeber that 24/7. They were friends 1st and its their BIZNESS if they want to be friends, lovers or NOTHING NOT the judges. I dont see this order lasting 5yrs at all though.

God Bless CB and Rihanna I support them BOTH! They are both young and have alot of maturing to do over the next few yrs

  • http://intensedebate.com/people/samantha2 samantha

cnt believe she made it to 100 yards now..she on some crack i swear..LOL.

  • http://intensedebate.com/people/samantha2 samantha

at least its over.he can do comm.service though out the 5 years, which is good.

    time for some music now…

  • Kiss Kiss

He is not going to "accidentally" run into her. His people will do their job. She is NOT going to appear in front of the world and ask for it to be lifted risking her supporters to turn on her. Not happening no way, so that order will stay in place for some time.

I'm ecstatic that it is still in place and the chit chat of togetherness will come to an end.

You looked good baby boy, stay straight… it'll be over…maybe sooner than later.

  • http://intensedebate.com/people/Tima1 Tima1

What is so harsh & unrealistic about this Protective Order? Sorry but the points you make are a bit unrealistic. I love & support Chris infinitely & felt the altercation on his part was self defense all along (just a personal belief), but Chris did plead guilty to FELONY ASSAULT WITH INTENTION OF COMMITTING BODILY HARM. This kind of stay away order is not drastic nor leaves room for any infringement to occur again.

Industry events do not have place these two less than 10 ft away from each other. These events are normally enormous & their seating arrangements in the past have been obviously arranged so they could be together. I doubt that any event producer would have them presenting or performing together anyway.

Regarding her attorney saying Robyn would have had to be there physically, is not correct. If you listened to the judge, she made it clear to Mr. Etra that this was the order in place until 8/24/2014 & there is no room for contest on either part in a formal hearing. Whether she was there or not this was a final ruling.

I can hardly wait for the "real" new single from Graffiti also!:D

Btw, sorry but Chrianna have left the building for real this time!

  • http://intensedebate.com/people/annie92 annie92

and the reason for u sending me this was?… i don't really care about that dumb whore so save ur shit. and btw this is just her side of the story. where's Chris'?

  • Lotus

Man my heart aches for him right now, but I know deep down that he will do all that he can to make sure that he does what he needs to do and te jugde through time will lessen his charges. He has got a long road ahead of him but he is smart and he has GOD on his side. I just can’t wait for him to just get back on that music hussle and give us that album. I do not agree with 5 years probation that is just way too long!!! But I pray for him all the time and don’t plan on stopping and I know he’s going to be alright.

  • http://intensedebate.com/people/Tima1 Tima1

Sorry but IT IS FINALLY, OVER, DONE! :S

  • http://intensedebate.com/people/Tima1 Tima1

I believe everything is in Divine order so Chris is where he should be in life right now.

I am going to say her lawyer knows what he is talking about he said she could come to court and request a modification this was AFTER todays court hearing and the lady who spoke before him said it can be reviewed again on Nov 19th as well

There ppl are going to do their jobs just like when they ended up at the SAME hotel in NY? If they are NOT supposed to have any contact with each other I doubt their camps are still in contact. The stay away order needs to be kicked to many hoops to jump through for the next 5yrs who wants to go through all that to avoid somebody you are friends with at that.

  • http://intensedebate.com/people/Tima1 Tima1

    @No comment
I LISTENED TO THE SENTENCING & YOU SHOULD TOO. THE JUDGE WHO IS OF HIGHER AUTHORITY THAN ROBYNS LAWYER, SAID THAT 2 HIM & ROBYN AT THE JUNE COURT APPEARANCE, NOT TODAYS FORMAL SENTENCING.

  • http://intensedebate.com/people/Tima1 Tima1

NOV 19TH IS FOR CHRIS TO PERSONALLY SEE THE JUDGE FOR AN UPDATE ON COURT ORDERED DV COUNSELING & COMMUNITY LABOR. IT IS CLEAR THAT THE JUDGE ONLY CARES ABOUT SEEING THAT THE SENTENCE FOR THE CRIME IS BEING SERVED JUSTLY TO THE COURTS SATISFACTION & HIM NOT HARMING THE "VICTIM" OR ANYONE ELSE FOR THAT MATTER. HER INTEREST IS NOT WITH THEIR LOVE LIFE!

  • http://intensedebate.com/people/Tima1 Tima1

    @diva
Agreed but he did agree to it by pleading guilty :S

  • http://intensedebate.com/people/Tima1 Tima1

    @oceanmate
why is 1100 yds troubling? Itt is very unlikely for a chance meeting while he' in VA doing labor & DV counseling. I mean why would Robyn be there?

Bottom line is the judge has phone records fm both their phones up until the time of sentencing. What she saw may have presented red flags & she is looking out for his best interest She even said she's not immune to what's being said on the airwaves about them meeting up & she doesn't believe in hearsay, so it appears that something was up. He's the one who can go to the California State Prison especially if they get into it again.

  • http://intensedebate.com/people/Tima1 Tima1

    @Kiss Kiss
THANK YOU FOR COSIGNING ON THIS! SHE WOULDN'T GO PUBLIC TO HELP SAVE HIS CHARACTER, SO SHE NEEDS TO JUST KEEP IT LIKE THAT!

  • http://www.intensedebate.com/people/annie92 annie92

i don't agree with the sentence, but yay! this ridiculousness is finally over with! :)

edit: and he's lookin real good in that suit! lol i love him!

I’m just soooooo glad this is over with! Me and my homeboy @ work think that this is messed up! All I can say is wow regarding his sentencing…. although, I will admit that I am a little disturbed about the sentencing. But, 5 years probation is better than jail time. I just wish it was 2 or 3 yrs. Along with the 5 yrs, she added an extra 50 yards to the previous stay away order… but she (the judge) states that “she is not one to believe hearsay and was not immune from the chatter that has been on the airwaves” hmmm. But, I am glad that he gets to do his do his community service during the span of his 5 year probation…very glad! There are other people @ my job who are much older that supports Chris as well. I’m not gonna repeat what some of the women have been saying all along regarding this situation. They are definitely behind him 100%. My homeboy told me that Chris is his boi too and that he feels the same way. The sentence is WAY too harsh! It bothers me but it is, AS IT HAS ALWAYS BEEN, in GOD’S HAND!

  • LadyInRed

(Cont)Judging from what I saw of Chris’s mood today, it seems like he was okay with everything and it was great seeing him being able to smile inside the courtroom. He looked relaxed and I like that! I can tell that he’s been ready to get this part over it. I’m not surprised at all that he asked the judge to do this 2 days sooner. I’m just so happy that this part is over with! Lol… if Chris were to report to that judge sporting his newly found muscles from doing his community service, she’ll probably have amnesia and forget all that she was gonna say to him just like that judge did on that episode on LL Cool J’s show lol! Looking like that cashier in the background of one of his recent pictures lol. Lmbo, Chris gone have folks bringing him home cooked meals while he’s out there doing his hard labor. Shoot, man if I lived there, I’d join in and bring you some good old southern cooking. Lmbo, shoots all your favorites lol!

  • LadyInRed

(Cont) Man, some homemade cornbread, canned yams, mustard or collard greens, macaroni and cheese casserole, corn casserole (my favorite), barbeque beef tips or ribs, potato salad, barbeque baked beans, chilli beans, smothered chicken and rice, cabbage, or go Italian with what ever kind of pasta, lasagna (my fav) garlic bread, some field peas w/snaps, turkey and dressing w/cranberry sauce, sweet peas, garlic mashed potatoes, baked chicken, roast and potatoes, dutch apple pie, peach cobbler, banana pudding, pecan pie, sweet potato pie, chess pie, buttermilk pound cake, home made STRAWBERRY CHEESE CAKE… ALLLL FROM SCRATCH! Lol… need I list more? Man, you better ask somebody…cause I can hook it UUUUPPP!!! LOL…Hey, I’m just tryna keep things positive and in a good mood in here! But also on a more positive note, I was reading where someone said that TMZ read a letter from a pastor stating that Chris is going to have a great future and that he is going to do big things in the future.

  • LadyInRed

(Cont) Tell me that this isn’t confirmation from God of what I stated awhile back about Chris… that God has HUGE plans for Chris and if Chris only knew what God has in store for him! Wow! Also, ol’ boy was rockin’ that suit today. Man, that suit was TIGHT! And, you know that I’ve always loved seeing a well dressed man. I love it when guys wear a vest with their suits. Shoot, that boy’s been stepping up his game every time in the suit department while going to court. I love the mustache… got that lined up nicely! Boy was on that grown man status today! I almost forgot how old he was for a min! Lol…DANG I almost forgot how old I was for a min lol! He looked REAL nice. But in all do respect, THAT BOY LOOKED GOOD IN THAT SUIT LOL!!!! Although, it would have been too much for this event, but for anywhere else, if he would have worn a hat (man I love those)… that would have been it for me! Lol… boy what you tryna do? Get me in trouble with God? Shoot, gone have me repenting tonight lol! LMBO, just kiddin’… or am I? LMBO!

  • LadyInRed

(Cont) But, as I’ve stated before, ALL THINGS WORK TOGETHER FOR THE GOOD OF THEM WHO LOVE GOD, WHO ARE CALLED (CHECK OUT THIS PART)…WHO ARE CALLED ACCORDING TO HIS PURPOSE! In due season, he will know what God is doing and why. I am curious to see where Chris will be in his life around the age of 25. I kind of have a vague picture of where he will be @ in his mid 30’s early 40’s. I guess we’ll see!
